indeed the policy of the law of agricultural tenancy in Bengal is to give protection to the actual cultivating raiyats and if one examines the scheme of the Bengal Tenancy Act he will find ample proof that an occupancy right is not dependent on the consent of the landlord. [...] Coming to the Contract Act prper we find that the commentaries of Sir Fredrick Pollock are chiefly confined to the exposition of the principles on which the provisions of the Indian Act are based by reference to the English law and leading English decisions with his own considered opinion with regard to the same. [...] During the preparation of the present edition his colleague Sir Din: shah Mulla was on special duty in the Legislative Department of the Government of India in connection with the framing of the Sale of Goods Act and the Partnership Act. [...] 92 was necessary neither was the consent of the Advocate-General necessary for the filing of the application for alteration of the scheme. [...] 447 of the Indian Penal 'Code may be committed even though the person in possession of the property is not actually present on the spot if the other elements of the offence exist.
