[...] The trial Judge and the Court of first appeal having found on the evidence that the land was not dedicated as a public grave-yard but was the private property of the Defendants dismissed the suit. [...] In the result the Chief Court decreed potSession of the land to the Plaintiffs by ordering the demolition of a door and a wall built by the Defendants. [...] (8) of the indent and by forwarding the invoice the Plaintiff firm substantially complied with the terms of the contract and the -failure of the Defendant firm to make payment and take up he goods conferred a right of re-sale on the Plaintiff. [...] – Where in an application for the revocatiq of a fc the applicant averred that the testator had no estate and that the prperties bequeathed were really the prperties of a.math of which the testator was the mohunt: Held (MACPHERSON and FAZL ALI JJ.)— That the applicant was not entitled to citation and had no locus standi in the Prhate Con rt.
