This is the priciple assumed by though not stated in the Act of Settlement just as the principle of the liberty of the subject is assumed by though not stated in the I labeas Corpus Act of 1679. [...] 80B of the Act says that they are not so' for the purposes of the sections yet the first Minister of Bengal used to assert that for all purposes he was a servant of the public atm not of the Crown. [...] 91 which assign to the Government of the Dominion the power to make laws for the peace order and geed government of Canada in relation to all matters not coming within the classes of subjects by this Act assigned exclusively to the legislatures of the Provinces." In fine though agreeing that the convention was not such a treaty as is defined in sec. [...] The Plaintiff brought the suit at Hoshiarpur in the Punjab and prayed for the attachment before judgment of certain meable properties of the Defendants at Kashgar through the Consular Court: Held (BROADWAY and ABDUL KADER JJ.) —That the Court at Hoshiarpur had no jurisdiction to order the attachment of the movable properties of the Defendants at Kashgar. [...] In a suit by the real creditor to which the debtor and the holder of a promissory note are parties a decree can be passed againgt the debtor safeguarding the interest of the holder of the note; therefore such a suit is ma intaina ble.
