Rferring io the lack of enthusiasm shown by certain of the States to enter the proposed Federation he points out that whether the States enter the Federation or not they canot object to the handing over to the central Government of India of the tributes payable by them to the Crown. [...] The provision only prescribes the procedure which shall be followed at the trial and is of the nature as the provision in r. 58 which says that the Court shall ivestigate the claim " with the like power regards the examination of the claimant and in all other respects " as if the claimant was a party to the suit. [...] Prior to 1923 the existence of reasoable grounds' for believing that the accused was guilty of the offence of which he was accused was sufficient to disentitle him to bail but in the present Code the legislature has enlarged the scope of sec. [...] The ingredients necessary to constitute the offence are (1) that the property which it is sought to recover must have been lost to the owner by the commission of an offence and this must be known to the person who takes the gratification and (2) that it must be proved that the person taking the gratfication refrained from using all means in his power to bring the offender to justice. [...] The section is not intended to apply to the actual thief but to some one who being in league with the thief receives some gratification on account of helping the owner to recover stolen property without at the same time using all the means in his power to cause the thief to be apprehended and convicted of the offence."
