In the People's Court which is the trial Court the permanent Judge is assisted by two assistants chosen from laymen to sit for a few days and although they have an equal voice in the judgment they do not take the same part in the proceedings and really discharge the functions of a jury. [...] Questioning the accused is not unknown in other countries as for example the Idian procedure sponsored by the British permits the Court to demand of the accused an explanation of the evidence given against him. [...] Held (KHAJA MAHAMMAD NOOR and DHAVLE JJ.)—That when there was a bond fide dispute about the very existence of a. tenancy between the Plaintiff and the Dfendants the Plaintiff denying the tenancy altogether and the Defendants claiming a tenancy at the rate of Rs. [...] That the guardian of a Hindu infant has power to mortgage or even sell the estate of the minor for the necessities of the estate or for the benefit of the estate is unquestionable.- Minor sued as major—Order by Court to take necessary steps—Appearance by minor through his guardian—No order of apointment and no amendment of cause title —Compromise by guardian with sanction of Court if binding [...] The fact of the minority of some of the Defendants having been brought to the notice of the Court the Court ordered the Plaintiffs to take necessary steps for the appointment of a guardian.
