But what does arouse interest is the recommendation that may be made in regard to one matter icluded in the Reference to the Committee namely “ the elimination or restriction of the rights of appeal to within or from the Supreme Court.” We are not concerned with appeals to the Supreme Court that is to say to the High Court from sribordinate Courts or with appeals within the Supreme Court th [...] But with regard to appeals from the Supreme Court that is to say from the Court of Appeal to the House Of Lords it is already being said in England that any re-organisation of the judicial system in this respect will probably involve the amalgamation of the House of Lords with the Judicial Committee. [...] The language of the statute is not happy but it certainly favours the interprtation of the applicants more than it favours the view taken by the High Court. [...] But when the statement has not been made in the course of investigating the offence in respect of which the trial is held neither the main part of sec. [...] In a suit brought by the second mortgagee to obtaic: possession of the properties purchaed by him: He'd (WALLER and KRISHNAN PANDALAI JJ.)---That the first mortgagee purchaser was entitled to retain his possession till he is paid off the amount of the mortgage and is not liable to be turned out of possession on the ground that the suit on the first morgage was improperly constituted and to
