The imperfect sumary of the proceedings before the Select Committee cabled tip India does not make it clear whether anyone raised the question of the appointment of members of the Indian Civil Service. [...] There must be sound reason behind the judicial system and the public opinion in England which make the appointment of non-lawyer civil servants to the position of Judges in the High Court impossible and that reason applies equally well in the case of India. [...] whatever the date of the tenancy or the terms thereof or the period for which the rent i3 due. [...] The case arose like this:— Soon after the original amendment the DistEct Judge of Sylhet (now the Legal Rmembrancer and Secretary to the Legislative Department of the Government of Assam) who was addressed by the Munsif of Halgani made a reference to the Assam Goverment. [...] Under the words of the law as it stands we cannot charge any court-fee for the extended certficate while we clearly see that the policy of the law is being defeated." On this the learned Judge observed :—" think the Munsif's view of the existing law to toe Technically correct.
