Proceeding to the powers of the federal legislature the learned writer points out that the subject of foreign relations of and with the States cannot be withheld from the Ministers if foreign affairs of British India are made ministerial. [...] He is of opnion that the over-riding power should etend to agreements referring to matters within the exclusive powers of a unit and that the power of securing the observance of decisions of the federal Court should not be vested in the Governor-General personally as proposed but in the Ministers. [...] More important is the sugestion that an appeal should lie to the Privy Council from advisory judgments of the fedral Court and that when a federal Court rfuses to hear an appeal from the High Court on the ground that the value does not reach the limit stipulated there should be an apeal to the Privy Council on the question of the interpretation of the limit. [...] It is no part of the duty of the Court to impose penalties for miconduct unconnected with the exercise of the profession which is either punishable or has been or can be punished under the law of the land. [...] Athough the words at the commencement of the section are " It shall be lawful " but in construing acts of public utility where the framing of the rules and the making of the appointment is necessary in order that the objects of the Act may be attained such words which might otherwise be considered permissive are really mandatory.
