From Reuter’s report of the discussion in the Committee of the House of Commons over the Chief Justiceship of the Federal Court it would appear that members of the Indian Civil Service would not be eligible for that position. [...] The acceptance of the amendment is a distinct gain to the administration of law and its only deficiency is that it is limited to the post of the Chief Justice. [...] As regards the Chief Juticeship it is pointed out among other things that the appointment of a Civil Service ludge ' will impair pulic confidence in the High Court both on account of his lack of legal training and his service associations with the executive% and the plea for at least two-thirds of the Judges to be lawyer judges is properly based on the technical legal requirements for the [...] The jurisdiction of the transferee Court over the subjecmatter continues as before and the 'mere fact that a certain procedure has not been coplied with is not fatal to the exercise of that jurisdiction which may be waived and the party who has acquiesced in the Court exercising their jurisdiction in a wrong way cannot afterwards turn round and challenge the legality of the proceedings. [...] Where a minor had sold certain goods to the Defendants and had delivered the goods and sued the Defendants for the price therof : Held (ADDIsoN J.)—That the minor was entitled to maintain the suit on the contract.
