Arrears and new institutions in the High CourOn taking his seat on Monday last the Honble the Chief Justice made a pronouncment as to the congestion of work in the High Court and the measures that had been decided upon for coping with the arrears. [...] The majority of the suits are by the landlord against the tenant or by the tenant against the landlord or by tenant against tenant or by one landlord against another. [...] Where there has been an opportunity afforded to one side to get an advantage with the arbitrator over the other either by lack of notice or by the absence of the other side and there is even a remote possibility that the advantage so obtained may have uconsciously influenced the mind of the arbtrator the proceedings are vitiated by the breach of the principles of natural justice and whethe [...] A resolution of the Directors of the Company sought to determine the cotract of managing agency: Held (BEAUMONT C. J. and RANGNEKAR J.) —That a provision in the memorandum of association for the benefit of a third party is not a contract between the Company and such third party and cannot be enforced in a suit by such party even though at the time of the suit he may be a member of the Copan [...] It is a well settled principle in Company law that the Court does not generally intefere with the internal management of the affairs of a Company and if the majority of the share-holders consider that a particular contract of employment should be terminaed the Court would not as a rule consider the matter at the instance of a minority of share-holders.
