The views expressed by the Conference by the second group of resolutions are of great importance and concern the administration of the law in general. [...] The fact that the receipt is signed by a person who is not proved to have had authority from him to receive is no evidence that the letter did not reach the addressee." It does not appear if the postman was called in this case but at any rate the letter was not delivered to the addressee but was delvered to another person and the gap in the evidence to prove that it did reach the addressee w [...] 114 of the Evidence Act that is to say by prsuming that the common course of business was followed and the postman did tender the letter to the proper addressee and did write his endorsement on refusal by the addressee to accept delivery. [...] Or it may even be said that the writing of the endorsement comes within the " common course of business " of the postman and therefore involves the presumption that it was properly written after a refusal by the addressee. [...] Whether or not a criminal act is done by several persons in furtherance of the comon intention of all is a question of fact to be determined on a consideration of the facts in each case and the common intention may be inferred from the circumstances discloed in the evidence and need not be the suject of an express agreement between the persons concerned.
