Under the latter Act the status of Vakils was the same as that of the present Advocates not entitled to practise on the Orginal Side that is to say that they had the right apart from any rules to act and plead in all non-original Side matters. [...] Secondly the particular rule conferring the right of appearance on Vakils is superfluous and if the effect of the rule be to restrict in any way the right of Advocates not entitled to practise on the Original Side it is ultra vices. [...] Such a right would vest in the survivors and would be the right of burying the dead bodies of the members of the family who die. [...] If the right of buring the dead is acquired in a limited way for instance the right to bury dead bodies underneath the ground allowing the surface to be cultivated it is 'difficult to say that the exercise of such right would necessarily tend to the total destruction of the property within the meaning of sec. [...] The case was in the stage of a preliminary enquiry and if committed would have to be heard eventually by the Sessions Court: Held (CURGENVEN and CORNISH JJ.) — That it is very unusual for the High Court to interfere with an order of the kind in such circumstances and it is undesirable that by a decision the High Court should:iterfere with the discretion of the Sessions Court which would have t
