The King has been pleased by Letters Patent under the Great Seal bearing date the 24th day of October los to appoint the Right Honourable Sir George Clans Rankin Knight to the office of one of the Members of the Judicial Committee of the Privy Council in the place of the Right Honourable Sir Lancelot Sanderson Knight K. C. who has retired. [...] On the day fixed the pleader for the Defendant filed an additional written statement and on the application of the pleader the Court framed a fresh. [...] 9 r. 13: Held (CURGENVEN and CORNISH JJ.)— That the acts of the pleader in filing an addtional written statement and in applying to the Court for the framing of a fresh issue were acts done by him in the conduct of the suit and towards the progress of the suit which had then been called in for hearing. [...] 9 (1) (c) of the Provincial Insolvency Act is not a period of limitation but a condition precedent to an order of adjudication ; an act of insolitency committed three months before the date of the presentation of the petition can not be availed of for an order of adjudication even though the day of epiry of that period falls within the vacation of the Court. [...] The business of keeping the line in order is as normal and as essential a feature of the running of a railway as the issue of tickets or the handling of goods.
