But once the evidence had satisfied the Court of the guilt of the accused we fail to see how the nature of the evidence could have any bearing on the question of sentence. [...] subject to considerations such as the age of the accused the absence or presence of prvocation and the nature of the crime. [...] The reference to the circumstantial nature of the evidence as one of the grounds for imposing the lesser penalty causes an uncomfortable feeling that the Court did not regard the evidence as wholly conclusive and that up to the last. [...] The proprietor defaulted in the pament of the revenue for the kist of the 28th March 1927. [...] 3 of the Revnue Sales Act coincided with the lcistbandi date the estate was not liable to be sold until the 28th March of the following year 1928; and that therefore the sale by the Collector was without jurisdiction.
