The importance which the Judicial Comittee attaches to the publicity of judicial proceedings appears from the circumstances of the case. [...] lie refers to the fact that the Defendant had in fact been appointed President of the Bench; goes on to add that both the Bench and the Court had actually been functioning; and finally emphasises the material existence of those tribunals by quoting the number of proceedings instituted before them. [...] On 7th April 1927 during the continuance of the execution proceedings the decreholder asked the Court to transmit the dcree to the District Judge of Campbellpore. [...] The Judge overruled the objection of the judgment-debtor that the execution application was barred by limittion on the ground that it was not open to him to go behind the order of the Judge at Mardan: Held (TEKCHAND and COLDSTREAM )— That a transmission order is a ministerial and not a judicial order. [...] The application made at Mardan for the transmission of the decree to the Court at Campbellpore was not a substantive applcation for execution and as the first applcation properly made for execution of the decree was presented more than 12 years after the passing of the decree and not being.a continuation of the application for exection which was pending in Marclan it was obviously beyon
