" If the defence is not proved and if the circumstances are such as prove dihonest conversion the charge is etablished." That is to say the charge is not established by the mere failure of the accused to prove his defence; another all-important factor is necessary namely sufficiency of the facts proved by the prosecution to establish the charge.
