Except the unfortunate and much miunderstood judgment in the case of Abdur Rahman v. Emperor the pronouncements of the Judicial Committee on criminal law though infrequent have always served to illumine the scheme of the statutes and to rationalise their application. [...] (J) 40 the parties are to apply as soon as possible for the rturn of the exhibits failing which the ehibits are to be destroyed and Rule 557 of the Rules lays down that unreturned exhbits are to be destroyed after the expiry of one year from the date of final order or dcree. [...] So one has to acount for the vast difference in respect of the law of inheritance between the Mitakshara and Dayabhaga Schools by a fundamental difference in the legal concepts of the jurists of these two schools influenced it may be by social or other local Conditions It seems to us that the rule under which the son acquired a share in the ancestral property from the time of birth must have b [...] In the absence of any provision to the cotrary the provisions of the Negotiable Istruments Act must be taken to be subject: to those of the Partnership Act when a negtiable instrument is executed by or in favour of a firm. [...] A part of the consigment having been lost the Plaintifle) brought the suit for compensation for an amount eexeeding the proportionate value of the loss according to the declared value of the whole.
