This ipression is a factor which has to be consdered in estimating the worth of the witness and thus in the total body of judicial work done in connection with a case there is a part which is the contribution of the Comissioner. [...] It refers entirely to the grounds set forth in the plaint as the cause of action or in other words to the media upon which the Plaitiff asks the Court to arrive at a conclusion in his favour. [...] Although the Court in oder to see whether the causes of action are identical or not is entitled to see whether the evidences required on the two cases are identical or not but the identity of the evdence is not the true and decisive test. [...] 104 of the Civil Procedure Code from such an order : Held also—That the part of the order of the lower Court to the effect that he dismised the application under para.
