The mortgagee obtained a decree and put the same into execution when a worshipper as representing the idol brought a suit for a declaration that neither the mortgage nor the decree thereon was binding on the idol and the properties were not liable to be sold in execution of the decree. [...] Justice Pal in the present case for the first time reduces the apparent confusion to order and defines clearly fully and logically the exact nature of the different rights which the idol the shebaits and the worshippers have in respect of endowed property and the consequences which flow from suits brought by them respectively. [...] Its progress through the trial Court was punctuated by sensation after sensation such as the belated appearance of the isurance report to provide striking support to the claim of identity in one particular and the appearance of a witness claiming to be the guru of the Plaintiff to denounce him as an impostor. [...] That was the reason why as different aspects of the case were being ufolded during the hearing of the appeal oservations came to be made from the Bench which seemed to conclude the case now In favour of one party and then of the other and it came to be a standing gibe to ask the lawyers engaged in the case both in the morning and the afternoon whether they were then losing the appeal or [...] The Defendant denies liability for interest and since the decision of the trial Court in regard to the extent of the liability has been modified by the High Court the Defendant is entitled to a certificate under sec.
