The amendment of the Criminal Procedure Code was made by Act XV of 1941 which received the assent of the Governor-General on the 20th November 1941. [...] So it is the duty of the Court at the time of passing the decree or after the decree is passed but the possession of the property remains undelivered to the auction-puchaser by the 1st day of January 1939 first to reduce the interest under the provsions of the Act and then to pass a new decree for the purpose of giving relief to the borrower by allowing instalment in a suit to which th [...] 34 (1) of the Act it is clear that legislature intended that the Court at the time of passing the prelminary mortgage decree will direct the Dfendant " notwithstanding the limit of six months provided therein to pay the dcretal dues in such number of annual istalments as the Court thinks fit having looked into other circumstances of the case. [...] The same principle I think will apply in the case of re-opening of decrees in money and mortgage " suits to which the Act aplies " and the provision for annual instaments would be made by the Court acordingly in the new decrees. [...] The first volume sets out the major Acts and the second volume the minor ones—with the Statement of Objects and Reasons in every case and some case-law on the setions.
