The last day of the Bengali year 1346 correponded to the 13th April 1940 and therfore the period of limitation for rent suits in respect of that year will expire on the 13th April 1943. [...] Ordinarily the last day of the current Bengali year and the last day of limitation for rent suits in respect of the fourth prvious year coincide; and since the last day of the Bengali year is always a holiday suits for arrears of four years can be and are filed on the re-opening day. [...] The Bar Association ef Laksmipur suggests that in the circustances the rule as to the compulsory use of cartridge paper should be abrogated and sanction should be accorded to the use of ordinary paper. [...] But where the order is passed after the sale has been held although the petition was filed before the sale and proceeds on the ground that the application is no tenable because the attachment has come to an end or that the claim cannot be adjudicated upon after the sale the provisions of r. 63 would have no application. [...] 21 r. 63 because under that rule the order must relate to the merits of the claim and must not be passed on the prliminary ground that the Court cannot equire into the merits of the claim.
