11 of the principal Act enacts that “ the fares and charges by this Act authorised shall be paid to such persons at such places upon or near to the tramways and in such manner and under such regultions as the grantees may by notice to be annexed to the list of fares from time to time appoint.” Sec. [...] 22 authorises servants of the Company to arrest and take to the nearest police station persons committing or atempting to commit the offence mentioned in the last preceding section if such persons refuse to give their name and residence and if the same be unknown to the Tramway 7viii THE CALCUTTA WEEKLY NOTES [VOL. [...] Of late the Company has been exhibiting in its cars a printed request to the passegers to pay the exact amount of the fare as the Company is not finding it possible to secure an adequate supply of small change. [...] This request obviously has not the force of a by-law or regulation and the question of the Company's duty to give change must be determined on principles of the general law. [...] If X offers goods for sale or offers his services or is a creditor and Y wants to buy any of the goods or have the services or pay off the debt it is his business to tender the proper price or the proms r amount of the debt in the proper form bfore he can require X to act upon the offer or give him a discharge.
