[...] A FULL COURT of all the Honߣble Judges of the High Court assembled in the morning of the 6th March in the Court-room of the Hon’ble the Chief Justice when a reference was made to the passing away of Mr. [...] 21 r. 63 is decreed the order passed on the claim petition is reversed by the decree in the suit and the successful party is entitled to restitution of the costs of the claim petition which he has paid to the Defendant. [...] Although the quetion of the costs in the claim petition is not specifically raised in the suit the reversal of the order or the decree automatically entitles the successful party to restitution of the costs paid to the successful prrty in the earlier proceeding. [...] 182 of the Limitation Act the starting point of limitation will be the date of the decree in the suit or if there is an appeal from that decree the date of the final orders on the appeal.
