The Calcutta Weekly Notes December 4 1944

1944

Now that the subject of the Daily Cause List is fresh in the mind of the authorities we take the liberty of reverting to a subject which we have discussed in these columns before. [...] If that be so the task of bringing and returning the proofs and of taking delivery of the printed list may be taken over by the Court itself or at least entrusted to someone of the agents who distribute the List. [...] 16f the agreement beween the parties is that the award must be a unanimous decision of the arbitrators if all the arbitrators have joined in the deliberation and have agreed in a certain decision then the award is binding on the parties even though one of the arbitrators accidentally inadvertently or deltherately did not sign the award. [...] It is the unanimous agreement to which all the arbitrators are required to agree; the agreement is the judcial determination of the dispute referred to the arbitrators by the parties. [...] The signing of the award is not a judicial act but is merely the record of that which has already been done in the judicial exercise of the functions of the arbitrators.
