EDITORIAL NOTES— NOTES OF CASES xx Notice of Appeal: fictitious date of hearing in We are pleased to find that our criticism of the form of address occurring in the vernacular version of the notice of appeal issued from the High Court under Or. [...] 41 r. 14 Civil Procedure Code of the date fixed for hearing of appeal.” And it ends with the following piece of fiction: “ Take notice that the day of I 19 has been fixed by the Court for the hearing of the appeal. [...] The information purported to be conveyed by the notice that the Court has fixed the date mentioned therein for the hearing of the appeal is purely imaginary because the Court has done no such thing. [...] The same is the position in regard to First Appeals with only this difference that a Respondent not etering appearance on the date mentioned in the notice loses the benefit of certain rights with regard to the inclusion and exclusion of papers in or from the Paper-Book. [...] The result of these mis-statements in the notice is that the Respondent being informed and warned of the so-called date of hearing by an Assistant Registrar of the High Court believes what he is told and subjects his Advocate to insistent demands for information as to the result of the appeal or as to at least what happened on that particular date.
