It has become necessary to draw the attention of the Government of Bengal to the necessity of phblishing an up-to-date compilation of the various Emergency Orders promulgated by them and the Regulations framed and issued from time to time. [...] In order to examine the validity of a conviction under one of the Emegency laws it hacj become necessary to ascertain what that law was and in spite of an adjourment having been granted it was not possible for either Counsel for the Crown or Counsel for the accused or for the Court to discover how the law really stood and where it could be found. [...] COLLISTER and ALLSOP J J. ) The Bombay High Court within whose juridiction the Respondent was residing having taken a contrary view the order of the Allahbad High Court was to send a bailable warrant to the Inspector-General of Police U. P. to be executed if and when the Respondent might be found within the local limits of the Court's jurisdiction. [...] Where all the facts are before the Court a plea of res judicata can be raised for the first time in appeal even though it was not raised in the pleading or in the issues but not when it will he necessary to remand the case for ascetaining facts. [...] Where the " occupier " of a factory who was the owner of the plant and machinery but not of the building and had to insure the factory icluding the building under Ordinance XII of 1942: Hcld -That he was entitled to set off the prmium in respect of the building against the rent.
