The acquaintance which he acquired with the woes of the peasantry at the time of the Bardoli Satyagraha in 192S when he appeared on behalf of the peasants bfore the Broomfield Committee probably brought about a qualitative change in his attitude twards politics. [...] 61 applied to the case and the time from which limitation began to run was the date of the actual paytnent of the debt and not the date of the execution of the promissory note. [...] In the absence of anything to the contrary if a claim is within limitation according to the old Act on the date when the new Act comes into force and a proceeding is commenced after the coming into force of the new Act it is the new Act which would govern all decisions on the point of limitation. [...] If however the right to sue or the right to apply has already been barred by the provisions of the Limitation Act then in force then unless there is something in the latter Act which can be deemed to apply retropectively to revive claims which had already bcome barred the new Act cannot be availed of for the purpose of saving limitation. [...] If during the progress of the suit and before the final hearing the Plaintiff abandons his claim to specific performance or disentitles himself to that relief by some act on his part he cannot claim or be awarded by the Court damages in lieu of the specific perforance of the contract.
