But it appears that the constitution has been so drafted not in form but in substance that in order to apply one of the very important clauses— regarding the jurisdiction of the Supreme Court—the Judges would have to be aquainted not only with the English laguage but also with the history and highly technical rules of English law itself. [...] In India the experience of the English lawyers in these tespects have been utilised and remedies in the nature of some of these writs have been made part of the law of the land e.g. [...] As will appear from the following figures compiled from the monthly list of June 1947 about 50 per cent of the civil business of the High Court comes from Eastern Bengal and would be tranferred to the High Court of the new Province. [...] in Calcutta or to join the new High Court would to a large extent depend upon the political situation in the newly constituted Prvince the constitution of the new High Court and the opportunity afforded there to the Advocates to practise their prfession. [...] It may be pointed out however that the present strength of the nuber of Judges is not sufficient to cope with the volume of work and huge arrears of business have accumulated ; and it may be necessary for at least some time to maintain the present strength to clear up the arrears.
