1948

We are glad to find that the Hon'ble the Chief Justice he head of the judiciary in the Province took prompt action and asked for an imediate explanation as to whether this was the practice in the Police Court. [...] This case and some other cases reported by us in which it appeared that the Executive Government was trying to bring pressure upon the magistracy demonstrates the necessity of separating the Judiciary and the Executive in order to maintain the independence of the Judiciary and uphold the rule of law. [...] We drew attention last week to the ipropriety and in our opinion unlawfulness of the publication of the alleged statement by and the photograph of the man arrested in connection with the assassination of Mahatma Gandhi. [...] There is no quetion about the urgency of the Kashmir problem ; but the way the wind began to blow in Lake Success made it very clear that the Indian delegation's case would not have the hearing it deserved and it became therefore imperative for the Indian delegation to contact the Government at home and be armed with instructions appropriate to a changed situation. [...] This was accopanied without doubt on the insistence of the democratically minded Indian Government by the release from jail and installation in authority of Sheikh Abdullah indisputable leader of the Kashmiri people and by the assurance that in order to lay all misgivings at rest a plebiscite in regard to the accesion to the Indian Union would be held at the earliest opportunity.
