SIR Will y ou kindly publish the following in your columns with your considered opnion in the matter as it involves a question of some general importance regarding the jurisdiction of Civil Courts in the Domnion of Pakistan to entertain and try suits against the Dominion of India regarding claims for compensation arising out of Railway consignments whi [...] By the Indian Independence (Rights 'Property and Liabilities) Order 1947 the liabilities and financial obligations of the then Government of India arising out of transactions prior to the 15th August 1947 have been divided between the Dominions of India and Pakistan and the respective liabilities and financial obligations of the two Dominions have been specified therein but no express provisio [...] pending on 15th August 1947) the diffigulty seems to have been removed by the salutary provisions of Article 12 of the Rights Property and Liabilities Order and Articles 3 and 4 of the Legal Proceedings Order and as a result of these provisions the Civil Courts of one Dominion have been vested with full jurisdiction to try suc4 suits.against the other Dominion.
