The intention of the framers of the Costitution as evident from the statement made by the President of the Constituent Assembly and as also expressed by the Government of West Bengal seems - to be that any person who has taken up a fixed habitation in India as also any person who after residing in India for one month files a declaration of his desire to acquire domicile would be entitled to be [...] (i) if he has taken up a fixed habitation in the territory of India or If a person at the date of commencment of the Constitution has taken up a fixed habitation he would be entitled to be a citizen of the Indian Union whether the taking tp was for the purpose of prfession or calling or otherwise. [...] The "existence of two sets of Courts in the same State one controlled from the Centre and the other by the States Would lead to serious anomalies and conflict of jurisdition. [...] While we deprecate the idea that there should be parallel Courts in the Province we are of opinion that the High Court should be made independent of the Prvincial Legislature and the power to costitute or re-constitute a High Court should be given to the Union Parliament if an address in that behalf is presented by the State Legislature to the President.
