Now that the object of parttioning Bengal has been achieved those leaders who once shouted at the top of their voices and demanded partition of the prvince on behalf of the minorities of Eastern Bengal and as a result have been awarded prize posts under the Government are now in an entirely different tone advising the minorities of East Bengal to stick to their positions. [...] On top of this the frequent utterances of the Muslim leaders including those of some who occupy high positions under the Government to the effect that Pakistan will he an Islamic State and rubs) according to Shariat law certainly raise a genuine apprehension in the minds of the people belonging to the minority commnity that they have no rights in their own country. [...] Item I of List III is as follows : " Crimnal law including all matters included in the Indian Penal Code at the date of the passing of this Act but excluding offences against laws with respect to any of the matters specified in List I or List II..." The High Court was further of opinion that the Legislature was really here seeking to remove the social disabilities from which the Harijans had [...] The High Court has interpreted the Act in the light of the needs of the society and the State and has done right in rejecting the narrow view held by the lower Court. [...] We think the High Court was hard put to it to get rid of Item 28 in List II and on the strict interpretation of the plain language of the item and of the Act the decision of the Bombay High Court may be open to question.
