Of the many and important powers prvided for the President that stipulating his authority to issue a simple executive order to prevent access to the Courts for redress against alleged violation of the much-trupeted fundamental rights came in for the gravest opposition from the few members of the Constituent Assembly who find it not too indiscreet to exercise some little freedom of speech a [...] The net result is that whereas for an arrear of rvenue the estate is liable to be sold after the expiry of the latest date of payment it cannot be sold to recover an arrear of cesses as an arrear of revenue immediately after that date as there must elapse another latest date of payment (which is to come about three months later) for payment of cesses as an arrear of revenue. [...] If on the other hand there is default in payment of revenue on the latest date of payment as well as df;itilt in payment of an arrear of cesses the estate can be put up for sale on the next sale date only for non-payment of revenue hit not also for non-payment of an arrear of cesses as an arrear of revenue. [...] The Amendment contains no preamble; it is enacted because it is expedient futher to amend the Bengal land Revenue Sales Act." If the object of the Amenment is to make provision for simultaneous realisation of arrears of revenue and cesses as arrears of revenue the Amendment stultifies itself by overlooking the effect of sec. [...] 37A of the Act to set aside the sale that the Collector can enforce pament of all arrears of cesses not by reason of anything in the amendment of sec.
