Frankly also we are severely critical of the policy of the Goernment of India following presumably upon the trend of discussions in the Consttuent Assembly in regard to High Court fudges their emoluments their terms of service and the restrictions imposed on them after. [...] He points out very reasonably that the intention of the Legislature has not been reflected as it should be in the body of the Act. [...] 1946 Held—That the rights to the agricutural lands were governed not by the Act of 1937 or the amending Act of '1947 but by the ordinary Hindu Law according to which on the death of the husband of the Plaintiff his brother became _sole owner of the agricultural lands and that the widow had no share therein. [...] The right of succes Sion was to be decided with reference to the death of the Plaintiff's husband and not to the date of her suit. [...] 26 r. 15 of the Code of Civil Procedure should be construed as inchtenig only the costs that the Commissioner has to incur for summoning witnesses and for other incidental expenses relating to the examination of the witnesses before him and that is also the ordinary meaning of the phrase.
