A Full Bench of the Calcutta High Court consisting of G. N. Das S. B. Sinha K. C. Das Gupta P. B. Mukharji and Jyoti P. Mitter J J. has recently prnounced on the question ably and comprhensively mooted before it of the legality of the Preventive Detention Act (IV of 1950) in view of the provision of certain rights to freedom in the pail of the Costitution that deals with Fundament [...] Three of the learned Judges took the view that the Act was not void while two of them Sinha and Das Gupta j J. opined to the contrary. [...] 14 of the said Act which requires that the grounds of detention communicated to the detenu and his representation against it cannot on pain of penalty be disclosed even in Court was void and of no effect. [...] The proof of the pudding says the people’s wisdom enshrined in proverbs is in the eating. [...] It cannot besides be fogotten that the trade stand-still between the two parts of divided Bengal the currency imbroglio and over-shadowing perhaps all else the Kashmir deadlock have still to be resolved and the psychological malaise which poisons the atmosphere of IndPakistani relations cannot easily be cured.
