227-28): “ In 1946 one of the secretaries of the Brazilian Embassy Pinha Suares was rquested by the Ministry of Foreign Affairs of the U. S. S. IL to leave the country as the result of an incident which he had prvoked in the Hotel National. [...] The Judicial Committee held that in the light of the concurrent findings of fact in the case the.plea in defence viz. [...] There was differences of opinion in the Supreme Court of Canada but the result of the majority decision was that the order of the trial Judge was restored. [...] levied was also considered in the abovmentioned case and it: was held that penalty was to be levied according to the law at the time of enforcement on the amount of dficit stamp calculated according to the old Act. [...] To my humble view the stamp duty and penalty should be levied according to the old rate as the cause of action of the suit arose long 1 efore the enactment of the amended Act.
