Of the three items set out in the charge as constituting the common object of the alleged unlawful assembly dispossesion of the complainant was the most iportant one the other objects being more or less subsidiary. [...] If there was an unlawful assembly the identity of persons compriing the assembly was a matter relating to the determination of the guilt of the indivdual accused. [...] One of the articles spoke highly of the qualities of candidate for election of leader of the Cogress Legislative party characterised the opposition as one without reason based on mere rivalry intrigue enmity and comunal frenzy of a selfish group of Brahmins out to maintain the domination of Brahmins and ultimately deplored the stirring up of enemity between Brahmins and Non-Bramins al [...] The other article in a strong language portrays the evils of the ancient system of Braminism which is rooted in social injustice and has always denied to the majority community of non-Brahmins equal rights and facilities in educational economical; political and other fields and in the concluing portion pleads for destruction of the system by the cultivation of unity discipline courage an [...] When an editor only sets out to ventilate the grievances of a community and in course of doing so criticises adversely the action of the other community it does not fall within the mischief of the Act.
