Justice Roxburgh is the last English Civlian judge on the Bench of the Calcutta High Court and whatever differences of opinion there might be about the system of recruitment of High Court Judges from among the members of the Indian Civil Service there can be little doubt that some of the English Civilian Judges possessed. [...] Sub-section (2) of section 9 of the Rent Control Act of 1950 lays down the procedure when the Rent Controller is required by the Act to determine the rent at which the premises were let out on 1. 12. [...] If it is not reasonably practcable to obtain sufficient evidence for dtermining the said rent the Controller is required tc determine approximately the tent at which in reasonable probability the premises were let out on the date and the rent so determined shall be deemed to be the rent at which the premises were let out on 1. 12. [...] Primarily it is the responsibility of the Controller and the landlord owes a duty to find out and tell the Controller what the standard rent is.
