The Supreme Court besides being the highest court of appeal was the inheritor of the traditions of the Judicial Committee of the Privy Council. [...] The judgment was of the Hyderabad High Court and the apeal against the judgment came to he disposed of by the Supreme Court under Article 374 (4) of the Constitution. [...] The decision of the Hyderabad High Court was perhaps correct in view of the law as laid down by the Judicial Comittee of the Hyderabad State. [...] In the istant case both the decrees were in the same case and based on the 'same judment and the matter decided concerned The whole suit. [...] The Supreme Court held that in view of the conflict of decisions on the point the High Court was wrong in not giving the appellant the bnefit of section 5 of the Limitation Act.
