Besides would not a case filed under the general law involving substantial question of law as to the interpretation of the Constitution the determination of which is necessary for the diposal of the case stand transferred to the High Court for determination of such question under art. [...] What is the evidence to be directed to ? The meaning of the "system poplarly known as etc." or its existence or both ? If evidence i. to be adduced only to prove the existence of the "system ppularly known as etc." then apparently the meaning of the words is known. [...] If the parties can offer evidence of the exisence of the system Judges will allow them to do so and the evidence if it proves the existence of the system will also establish its meaning. [...] The duty of interprettion is a duty of the Judge and not of the parties. [...] The Rules must be subject to the provisions of the Act as clearly mentioned in the beginning of section 25(2).
