The facts were as follows The plaintiff and one S. both showmen and members of the defendant guild applied to Bradford Corporation for a site on the fair ground for the Bradford Moor Fah The plaintiff was allotted the host position which S. claimed in accordance with a previous ruling of the guild he was entitled to. [...] The rules of the guild provided for imposition of fines on any member who broke the rules and if the fine was not paid within a month the member was deemed to have ceased to be a member of the guild. [...] 226 of the Constitution for quashing the declration Hild—that the High Court had power to issue the writ of certiorari; that the declaration should be quashed and the Collector ordered to proceed afresh with the hearing of the objections of the pettioner after affording proper opportnities to.the latter to be heard. [...] The workman's widow having applied for compensation the ouestion arose whether the accident in question arose 'in the course of and `out of his employment a nd whether A.ie was entitled to compensaton Held : that the accident arose 'in the course of and 'out of the employment anc the v. orkman's widow was entitled to compensation under the Workmen's Compensation Act. [...] The expression 'out of in "arising out of his employment " conveys on a literal and strict construction of section 3(1) of the Act the idea that there must he some sort of connection between the employment and the injury caused to a workman as a result of the accident.
