Under the Special Marriage Act of 1872 persons who do not profess Christian or the Jewish or the Hindu or the Muhammadan or the Parsi or the Buddhist or the Sikh or the Jaina religion and persons each of whom professes the Hindu Buddhist Sikh or Jaina religion can marry (sec. [...] There has been a re-statement of prohibited degrees of marriage in simpler terms : “Two parties are said to he within the 'degrees of' prohibited relationship' if one is lineal ascendant of the other or was the wife or husband of a lineal ascendant or descendant of the other or if the tvc are brother and sister uncle and nieo aunt and nephew or the children of two brothers or of two sisters.” [...] If the Special Marriage Bill of 1953 is regarded as the first instalment of Hindu Code Bill relating to law of mariage persons professing that faith would prefer a consolidated Act of marriage which would re-state the law simplifing - amongst other things the prohibied de:gees of marriage and modernising Various old concepts which are outmoded As the Objects and Reasons of the Bill [...] (3)' Save as provided in sub-section (1) or sub-section (2) the provisions of the Code of Criminal Procedure 1898 shall so far as they are not inconsistent with this Act/ apply to the proceedings before a special judge; and for the puposes of the said provisions the court of the special judge shall be deemed to he a court of session trying cases without a jury or without the aid of assessor [...] 9. APPEAL AND REVISION.—The High Court may exercise so far as they may be applicable all the powers conferred by Chapters XXXI and XXXII of the Code of Criminal Procedure 1898 (Act V of 1898) on a High Court as if the court of the special judge were a court of session trying cases without a jury within the local limits of the jurisdiction of the High Court.
