The First Infomation Report named seven accused and the Sessions Judge who tried all the seven with the aid of assessors convicted each of the seven accused under section 302 read nvith section 149 of the Indian Penal Code. [...] In these circumstances the Supreme Court reviewed the evidence and agreed with the Sessions Judge and held that the eye-witnesses in the case correctly named all the seven accused as the assailants. [...] If there was an unlawful assembly the Identity of persons coprising the assembly was' a matter relating to the determination of the guilt of the individual accused. [...] The first 4o pages of the book contain a masterly analysis of the amendments by the Indian Income-tax (Amendment) Act r953 and the Finance Mt 1953. [...] In view of the expression in respect or the Legislature must be taken to have wanted the penal consequences of the setion to apply to any nexus between the receipt by a landlord of a premium and the grant of the lease.
