But in the modern civilized age a magistrate or a judge feels that his function on the Bench is to administer justice and that it is his duty to be fair to the accused and at the same time to protect him from any unfair treatment in the hands of the public prosecutor or the Police. [...] It is an essential principle of the law of arbitration that the adjudcation of disputes by arbitrators should be the result of the free consent of the arbitrators to act ; and the finality of the award is based entirely upon the principle that the arbitrators are judges chosen by the parties themselves and that such judges are willing to settle the disputes referred to them (I. [...] Persons not attending in accordance with such process or making any other default or refusing to give their evidence or guilty of any contempt to the arbitrator or umpire during the investigation of the matters referre41 shall be subject to the like disadvantages.penalties and punishments by order of the Court on the representation of the arbitrator in suits tried before the Court. [...] It is very improper in an arbitrator to accept hospitality from one of the parties; and if the invitatioft be given with the intent or have the effect of inducin the arbitrator to act unfairly the Court will set aside the award (Roscoe's. [...] The first Court held that Plaintiff being one of the tenure-holders for whose default in the payment of rent the tenure was sold could not by virtue of his purchase avoid the incumbrance in view of the last portion of sec.
