2) which provides that the guardian of the person of a minor (when guardian of his property cannot be lawfully apointed) may give consent on behalf of the minor to the tying up of the estate for four generations in the hands of the karta or in the line of the eldest son or to any of its either marvellous modes of settlements. [...] But the Guadian and Wards Act confers no power on the guardian of the person of a minor in respect of the property of the minor and that for obvious reasons. [...] Apart from the question of provocation in the pre7 sent-Russo-Japanese war the landing of the Russian\ contingent at the mouth of the Yalu river was tantamount to a declaration of war. [...] The proces4 issued under the 190th Rule of Court calls upon the Attorney-General as well as the Resident Magistrate of Durbanville and Malmesbury respectively to show cause why certain proceedings of their respective Courts shall not be set aside or corrected on the grounds (a) of gross irregularity in the proceedings and (b) incopetency of the said Courts in respect of the cause King v. V [...] Among the grounds on which it is competent to bring the proceedings of the inferior Courts under review are incompetency of the Court in respect of the cause including all excess of juridiction and gross irregularity of the proceedings.
