And in view of the fact that there is suffcient indication in the explanation submitted by the additional Sessions Judge that he has taken a very strong view of the case and that he has in a great measure formed a very strong opinion in respect of the guilt of the accused and also in view of the fact that there are circumstances which may render it desirable that the Sessions Judge should be [...] 178 of the Limitation Act and the limitation began running from the date of the decree of the Appellate Court and not of the High Court.affirming the same on second appeal. [...] The possession of the estate was however undoubtely with the Respondent Raja Shahan All Khan and for this reason an order was passed on the 5th February 1895 directing the entry of his name in the Revenue Registers On the 4th October 1895 Musatnmat Shafiqunnissa instituted the present suit in the Court of Additional Civil Judge or Lucknow to recover possession of the whole estate of Raja Na [...] The Appellant had obtained a decree for money against the father of the Respondents and the father being dead applied foe the substitution of his sons ovthe record and the execution of the decree. [...] The Subordinate Judge held that the property was ancestral and that the sons were not under the circumstance the legal representatives of th1 judgment-debtor and he refused to bring them on the record in the place of the deceased judgmentitigetir.
