We entirely agree with the observation of the learned District Judge that the circumstances are ugly and that between the astuteness of the Collector and the folly of her agent the Plaintiff has suffered real hardship It is of the utmost importance that sales under Act XI of 1859 the provsions of which in the interests of the State have a character of unusual stringency should be conducted [...] The question was whether the service of the writ in the action should be set aside on the ground that the Appellant was induced to come within the juridiction by means of false representations and tricks under such circumstances as to amount to a fraud and an abuse of the process of the Court.
