But all the same the people of the Presidency of Bengal are under deep obligation to His Excellency the Viceroy for the annulment of the Partition of Bengal and the raising of the Province to the status of a Presidency Goverment. [...] From this and other evidence the Court of Appeal was satisfied that the repentance of the prisoner was genuine and the Court was of opinion that a long term of imprisonment was not calculated to prmote the reclamation of the prisoner to an honest life. [...] The Plaintiff sought to prove the deed by (1) the statment of a witness examined in the case who claimed to be acquainted with the handwriting of two of the attesting witnesses (2) a deed of usfructury mortgage executed by one of the exectants of the mortgage in suit and the represenative of the two other executants which referred to and recognised the genuineness of the mortgage in su [...] The demand of the zemindar was in conformity wit h the custom that prevails in the country that when a zemindar’s house is burnt down the tenants contribute towards the rebuilding of the house just in the same way as when a tenant’s house is burnt down the zemindar contributes towards the rebuilding of the tenant’s house. [...] An issue was framed during the trial before the Munsif as to whether the Defendant was a sutenant under the four tenants of the Plaintiff or not and the finding of the Munsif was that he was a co-sharer of the four tenan s of the Plaintiff.
