1914

With reference to the decline in appeals it is worthy of note that in the Court of Appeal the decline was 87 in the Divisional Courts 71 in the Judicial Committee 28 and in the House of Lords only I. The Judicial Committee however worked energetically and disposed of 132 appeals in 1912. [...] On information laid by one of the creditors the Receiver appointed by the Court under the Provincial insolvency Act seized certain moveable property" as property of the insolvents in order to dispose of the same for the benefit of the creditors. [...] The Plaintiffs objected to the award on the ground of the misconduct of the arbitrators and the umpire and on the ground that the application to the Court asking for a reference to arbitration was not signed by the guardian ad litem of a minor Defendant. [...] Subsequently the officiating Chief Commissioner granted a review to the Plaintiffs and set aside his predecessor's order on the ground that the reference to arbitration was made without juridiction in that the application to the Court was not signed by the guardian ad litem of the minor. [...] This decree modified the decree of the Munsif who granted the Plaintiffs possession of the 16 annas of the tank and also as a consequence mesne profits while the lower Appellate Court varied the decree but adhered to the award of mesne profits as against the co-sharers.
