And thirdly there is the intermediate position as was in the present cases where the pleasure of the Crown is subject to rules linked thereto by the statute but if the rules themselves prvide nothing beyond administrative relief the ultimate position is that the pleasure of the Crown prevails subject only to how the exercise of the pleasure may be regulated by its delegates in applying or on [...] It is remarkable that inspite of holding that the violation of the rules in each of the cases was flagrant and that the plea of substantial compliance taken in one of them was mischievous in tendency and ill-founded in fact their Lordships are able to say that they had no doubt that the charter and the pledge Contained in the statute and in the consequential rules were !generally observed and tha [...] 241 (2) for the making of rules by the Governor-General or the Governor as the case may be but the legilature is careful to provide that the condtions of service shall be as prescribed in the rules " except as expressly provided by this Act " that is to say subject always to the pleasure of the Crown.
